Terms and Conditions – Viante Health (1-8-2024)

Introduction

These Terms and Conditions apply to all services, recovery plans, courses, and digital products provided by Viante Health.
Viante Health is a trade name of Interbright, established at François HaverSchmidtwei 2, 8914 BC Leeuwarden, the Netherlands, registered with the Dutch Chamber of Commerce under number 58489843, VAT number NL001240765B22.
By using our website, digital products, or services, you agree to these Terms and Conditions.

Article 1 – Definitions

  1. Client / Customer: any natural or legal person purchasing or using services, courses, or digital products from Viante Health.
  2. Digital products: all online courses, recovery plans, programs, and downloadable content provided digitally.
  3. Recovery Plan: a personalized digital document prepared on the basis of an intake form, with or without follow-up Q&A support.
  4. Q&A Support: written answers to client questions within the limits of the purchased package; no live consultation is included.
  5. Agreement: the contract formed when a client purchases a product or service from Viante Health.

Article 2 – Scope

These Terms and Conditions apply to all offers, agreements, and services of Viante Health, unless explicitly agreed otherwise in writing.

Article 3 – Offers and Prices

  1. All offers are non-binding and subject to change without prior notice.
  2. Prices are stated clearly and include VAT where applicable, unless otherwise indicated.
  3. Viante Health reserves the right to adjust prices, products, or services at any time. For confirmed purchases, the terms valid at the time of purchase apply.

Article 4 – Health Disclaimer

  1. Viante Health provides recovery plans, Q&A support, and courses for educational and informational purposes only.
  2. We do not provide medical diagnoses, prescriptions, treatments, or cures.
  3. All information about herbs, supplements, nutrition, or lifestyle is general in nature and not intended as a medical prescription.
  4. Clients are solely responsible for verifying with their physician or pharmacist whether the use of any supplement, herb, or practice is safe in combination with their personal health situation and medication.
  5. No specific results are guaranteed; outcomes may vary per individual.

Article 5 – Use and Intellectual Property

  1. All content provided by Viante Health (texts, images, videos, audio, programs, techniques, and materials) is protected by intellectual property rights.
  2. Purchased content and services are strictly personal and non-transferable.
  3. It is prohibited to copy, distribute, publish, or commercially use any material without prior written consent.

Article 6 – Orders, Payment & Intake Completion

  1. An order is considered final once payment has been successfully completed.
  2. For digital products, the statutory right of withdrawal expires once access has been granted or the Recovery Plan process has started.
  3. Failure to complete or submit the intake form is not a valid reason for cancellation or refund.
  4. By purchasing a Recovery Plan, the client acknowledges that it is a personalized digital product, and that the statutory right of withdrawal no longer applies once processing has started.
  5. If access has already been provided or intake processing has begun, no refunds will be issued.

Article 7 – Recovery Plans and Q&A Support

  1. Recovery Plans are prepared after submission of the intake form.
  2. The client is responsible for completing and submitting the intake form after purchase.
  3. Not completing, delaying, or deciding not to submit the intake does not entitle the client to a refund.
  4. Plans are delivered digitally and based solely on the information provided by the client.
  5. In packages that include Q&A support, clients may submit a limited number of written questions, as specified at the time of purchase.
  6. Q&A support is provided only in written form (no live consultations).
  7. Access to the client portal is available for a maximum of three (3) months from the start date of the Recovery Plan, unless otherwise stated. After this period, access will automatically expire.
  8. The Recovery Plan PDF remains permanently available to the client once downloaded.
  9. No cancellations or refunds are possible once intake processing has started.
  10. Viante Health aims to deliver the Recovery Plan within 3–7 working days after receiving a completed intake.

Article 8 – Digital Products and Online Courses

  1. Access to digital products (including courses, modules, recovery plans, and downloadable content) is personal and non-transferable.
  2. Refunds are not possible once access has been granted.
  3. Viante Health may update or modify digital products at any time without obligation to retain earlier versions.
  4. Unauthorized sharing of content may result in termination of access without refund.

Article 9 – Liability

  1. Use of Viante Health’s services, recovery plans, and courses is entirely at your own risk.
  2. Viante Health accepts no responsibility or liability for any adverse effects, interactions, or complications resulting from the use of supplements, herbs, techniques, or recommendations mentioned in its recovery plans, courses, or Q&A support.
  3. Clients acknowledge that they are fully responsible for consulting a qualified healthcare provider before implementing any advice.
  4. In all cases, liability is limited to the amount paid for the relevant purchase.
  5. Viante Health is not liable for indirect damages, consequential losses, or lost profits.

Article 10 – Privacy and Confidentiality

  1. Personal data is processed in accordance with our Privacy Policy.
  2. All intake forms and personal information are treated confidentially and used solely for the purpose of delivering services.

Article 11 – Force Majeure

In cases of force majeure – including but not limited to pandemics, illness, or technical disruptions – Viante Health may suspend obligations or terminate the agreement without liability for damages.

Article 12 – Governing Law and Disputes

  1. These Terms and Conditions are governed exclusively by Dutch law.
  2. In case of disputes, both parties will first attempt to reach a solution through consultation or mediation.
  3. If unresolved, disputes will be submitted to the competent court in the district where Viante Health (Interbright) is based.

Article 13 – International Clients

  1. For clients outside the European Union, all services and content provided by Viante Health are intended solely for educational and informational purposes.
  2. Statements or products have not been evaluated by the U.S. Food and Drug Administration (FDA) or comparable authorities.
  3. By using our services, you agree that Dutch law and jurisdiction apply exclusively, regardless of your country of residence.

Appendix A – Specific Terms for Digital Courses & Recovery Plans

Access and Use

  1. After successful payment, you will receive access to the purchased course, program, or recovery plan.
  2. Access to the client portal is limited to three (3) months from the start date of the Recovery Plan, unless otherwise stated. After this period, portal access will automatically expire.
  3. Clients are responsible for downloading and securely storing their Recovery Plan PDF during this period.
  4. Access is strictly personal, non-transferable, and may be time-limited as specified at the time of purchase.

Content and Intellectual Property

  1. All content (texts, images, audio, video, documents, and other materials) is owned by Viante Health and protected by copyright laws.
  2. It is not permitted to copy, download, share, publish, or commercially exploit materials without written permission.
  3. Any technical protection measures may not be bypassed.

Right of Withdrawal

  1. By receiving immediate access to a digital product, or once intake processing for a Recovery Plan has started, you expressly agree that the statutory right of withdrawal is waived.
  2. No refunds are possible once access has been granted or intake processing has begun.
  3. Not completing the intake is not a valid reason for cancellation or refund.

Updates and Modifications

  1. Viante Health may modify, improve, or update course or recovery plan content at any time without the obligation to retain earlier versions.

Termination of Access

  1. If you violate these terms (e.g., by sharing materials without authorization), access may be terminated immediately without refund.

Appendix B – Specific Terms for Recovery Plans with Q&A Support

Scope

  1. These terms apply to Recovery Plan packages that include follow-up Q&A support.
  2. Q&A support is limited to written questions submitted via the designated form. No live consultations are included.

Nature of Advice

  1. All answers and recommendations provided through Q&A support are educational and complementary.
  2. They do not replace professional medical care, diagnosis, or treatment.
  3. Clients remain fully responsible for consulting a physician or healthcare professional when necessary.

Use and Limitations

  1. Each Q&A package includes a maximum number of questions as specified at the time of purchase.
  2. Questions must be directly related to the client’s Recovery Plan and intake.
  3. Questions outside the scope of the purchased package may not be answered.
  4. Viante Health aims to respond within a reasonable timeframe but does not guarantee specific response times.

No Guarantee of Results

  1. Outcomes depend on individual circumstances.
  2. Viante Health cannot guarantee that guidance through Q&A support will lead to specific results.

Cancellation and Refunds

  1. Recovery Plans are personalized digital products. Once purchased, the agreement is final. Not completing or delaying the intake does not entitle the client to a refund.
  2. No cancellations or refunds are possible once intake processing has started.
  3. If Viante Health is unable to deliver the Recovery Plan or Q&A support as agreed, the full amount will be refunded.

Confidentiality

  1. All information provided via Q&A is treated confidentially and processed in line with applicable privacy laws and our Privacy Policy.
